The Facilities Access Code

The ACCC has the power to make a Code, under Clause 37 of Part 5 of Schedule 1 of the Telecommunications Act 1997, which sets out conditions that are to be complied with in relation to the provision of access. The Facilities Access Code governs how access to certain telecommunications facilities owned by telecommunications carriers, including mobile towers and underground ducts, is provided to other carriers seeking to install their equipment on or in those facilities.

The Facilities Access Code was last reviewed and amended in 2013. In August 2018 ACCC published a discussion paper to commence a review of the Facilities Access Code. A draft report of the Facilities Access Code Review was published in 2019 and the final report was published on 25 June 2020.
