Honduras: Ley de Promoción de Alianza Público-Privada (Law for the Promotion of Public-Private Partnerships)

The Public Private Partnership Promotion Agency (COALIANZA) is responsible for managing a new investment model in Honduras, as a strategy to raise the country’s level of competitiveness and the quality of life for many families.

COALIANZA has been operating since 2010, based on the approval of Law Decree No. 143-2010 for Promoting Public Private Partnerships.

COALIANZA works as a decentralized agency from the President’s Office, with its own legal status and assets. It is responsible for managing public-private participation in public works and services projects.

Puerto Cortes Bulk Cargo Terminal Puerto Cortés (Terminal de Graneles de Puerto Cortés): Contrato de Fideicomiso (Management Trust Agreement)

Honduras - Puerto Cortés Bulk Cargo Terminal: Contrato de Fideicomiso para la Estructuración, Desarollo y Financiamiento de la Operación de la Terminal des Graneles de Puerto Cortés (Management Trust Agreement for the Structuring, Development and Financing of the Operation of the Puerto Cortés Container and Cargo Terminal) between the Comisión para la Promoción de Alianzas Públicas-Privadas (COALIANZA), Empresa Nacional Portuaria (National Port Company) and Banco Atlantida S.A. (Spanish). 

Corredor Turístico - Contrato de Concesión (Concession Agreement)

Corredor Turístico (El Progreso-Tela, San Pedro Sula – El Progreso y La Barca – El Progreso) - Concession Agreement between the Republic of Honduras (conceding authority) and the Consortium Concorcio Canal Seco (CASH) (concessionaire) for the construction, operation, transfer, and maintenance of a 122-km, four-lane highway along the Atlantic side of Honduras ("touristic corridor") under a design, finance, build, operate, transfer (DFBOT) scheme (Spanish).

Buses Terminal and Municipal Market of Danlí- El Paraíso, Honduras

Parties:

Municipality of Danlí (Department El Paraíso) through the Mayor;La Sociedad Fliefil S.A. y Asociados, S. de R.L. de C.V. (Private Partner); Coalianza, Hondura’s PPP unit, is party to the contract as Arranger of the project .

Main Features: 

Public-private partnership for the design, financing, construction and transfer of the updates to the Danlí- El Paraíso Bus Terminal and Municipal Market space, including 600 commercial market stalls and 20 bus terminals (Clause I.) 

Siglo XXI Project (Road Infrastructure Improvement), San Pedro Sula – Honduras

 

Main Features:  This project is a concession for the design, construction, financing, administration, maintenance and transfer of the road infrastructure public works of San Pedro Sula under the PPP modality (Clause II.)

Parties: Secretaria de Estado de Obras Públicas, Transporte y Vivienda –SOPTRAVI (Conceding Entity), Coalianza (PPP unit) and Consorcio SPS Siglo XXI (private partner) (Clause III.)

Term: The term of the concession is 15 years, which can be extended.

Law for the Promotion and Protection of Investments

This law considers both foreign and domestic investment as a primary interest of the State and sets out the basis for attracting, promoting and protecting such interests. For example, one provision creates Agrobusiness Export Parks in order to increase agricultural production through investment in infrastructure that would at the same time promote the inclusion of national agriculture micro, small or medium enterprises (MIPYMEs) in the value chains of the exporting enterprises operating in the parks.

CONSIDERANDO: Que mediante Decreto Legislativo No. 118-2003, de fecha 20 de agosto de 2003, con el propósito de regular en el territorio nacional los servicios de agua potable y saneamiento, fue emitida la Ley Marco del Sector Agua Potable y Saneamiento, publicado en el Diario Oficial La Gaceta el 8 de octubre de 2003, habiendo entrado en vigencia veinte (20) días después de su publicación;
