The law, Decreto-lei nº 63/2015 13 de novembro de 2015, defines the general rules applicable to the State's performance in prioritizing, designing, preparing, hearing and consulting public, tender, adjudication, alteration, inspection, global monitoring and extinction of public-private partnerships, PPP.
The Unit for State Business Sector Monitoring (UASE) results from the merger of the Unit for Privatizations and Public-private Partnerships (UPPPP) and the State Subsidiaries Service.

Public procurement in Botswana is mainly regulated by Public Procurement and Asset Disposal Act and and Public Procurement and Asset Disposal Regulations.
Rules for PPP implementation are codified in the Private-Public Partnership Law of 11 October, 2016.
The new Public Procurement Law, law no 41/20 of 23 December, entered into force 22 January 2021. The replaces the previous Law, no 9/16 of 16 June on Public Procurement.
The Act Public Procurement Act implements the European Directives 2014/24/EU (classic sectors) and 2014/25/EU (specific sectors). The Concession Act implements the European Directive 2014/23/EU.
Public Procurement Act for Concession Contracts (BVergGKonz 2018) implements the 2014 Concession Contracts Directive and regulates procurement of concessions.
