Hydrogen May Be The Crucial ‘Jigsaw’ Piece For Green Microgrids

Microgrids are set up for several reasons that include increasing a region’s resiliency — or its ability to maintain power as well as incorporating more renewable energy to cut down on CO2 releases. And they can be set up in remote locations that have no access to the centralized grid, thus creating more economic opportunities. But in the case of PG&E, it is looking to such localized delivery systems as a way to battle wildfires and to avoid wholesale blackouts.

ENGIE successfully refuels the world’s first renewable hydrogen passenger train in test in the Netherlands

The train is powered by a hydrogen fuel cell, which produces electrical power for traction. It emits only water and steam during operation, representing a clean alternative for the regional government looking to replace diesel fleets on non-electrified lines and meet their zero carbon emission objectives. In the Netherlands, the rail network is about 1,000 km of non-electrified railway lines.  Around 100 diesel trains are currently running on these lines daily.

Bringing PPP into the Sunlight – Synergies Now and Pitfalls Later?

Chapter 1 seeks to answer the question of whether PPPs are the “genie in the bottle” for governments seeking to plug the infrastructure gap: do they solve more problems than they create? This discussion lays the groundwork for further analysis. Chapter 2 explores the underlying reasons for the expansion of PPPs, the definitions and scope of PPPs in different contexts, and the historical trajectory of PPPs throughout the world, highlighting the common factors that have led to their current popularity. Chapter 3 details the multitude of institutional frameworks built to accommodate PPPs.

Victorian Desalination PPP

When built the facility - located at on the Bass Coast near Wonthaggi southern Victoria - will produce up to 150 billion litres of water a year, with the possibility of future expansion to 200 billion litres.

The plant will consist of:

  • 150 GL pa capacity desalination plant
  • intake and outlet tunnels, 85km transfer pipeline,
  • underground power transmission line and
  • 63MW wind farm to power the plant

Contracts and COVID-19

Part I of this Essay will describe the legal doctrines of Impossibility and Restitution and how they might apply to a contract undermined by the COVID-19 pandemic. Part II will explain how a Force Majeure clause alters those background doctrines to give—or withhold—relief to a party whose performance has been thwarted by the pandemic.

Covid 19, Frustration of Purpose and Impossibility

mpossibility—or impracticability—is essentially the inverse of frustration of purpose; instead of the purpose of the contract being made impossible, it is the actual performance of the contract that is impossible. Much like frustration of purpose, there are strict requirements that must be met to invoke this defense, namely the occurrence of a supervening event, the non-occurrence of which was a basic assumption on which both parties made the contract.

Typically, a Concession Agreement or a PPA will provide for Force Majeure relief to extend beyond the Concession Agreement/PPA to other project agreements that the Concession Agreement/PPA parties are also party to, including the EPC contracts or the O&M agreements. For example, where the occurrence of a Force Majeure event prevents the EPC contractor from building the power plant, the project company may be able to seek relief from its contractual obligation under the Concession Agreement/PPA.
