GLOBAL FORUM ON LAW, JUSTICE AND DEVELOPMENT: Sessions Dedicated to PPPs

SESSION 1:

Public-Private Partnerships - How Governments Make Better Decisions, November 18, 2015, 2:00-3:30 pm, World Bank, Washington D.C.

The first of a back-to-back discussion on PPPs, this session, sponsored by the Public-Private Partnership in Infrastructure Resource Center (PPPLRC), will focus on tools that can help governments make better and more informed decisions in PPP transactions, and issues to look out for, focusing on three areas namely : (a) process for selection and review of proposed transactions, (b) procuring and managing skilled transaction and legal advisors for PPP transactions, and (c) the Recommended PPP Contractual Provisions Initiative.

SESSION 2:

Small-Scale Public-Private Partnerships: Developing Urban Mobility, Environmental Improvement and Human Solidarity, November 18, 2015, 4:00-5:30 pm, World Bank, Washington D.C.

This second session on PPPs will discuss the relevance of small-scale PPPs from a development perspective as they enable public authorities to formalize their relations with small-private operators in order to improve the way public utilities are managed. Concrete examples to be illustrated include the small-scale PPP programs for waste management implemented in Recife and Sao Paulo as well as a small-scale PPP program carried out in Paraguay’s water sector.

Biographies

Speakers:

Mark Moseley (Presenter) is the Lead Lawyer in the World Bank PPP Group, currently on secondment to the Global Infrastructure Hub, based in Sydney. His work is primarily focused on the contractual arrangements for public-private partnership transactions and the legal and regulatory arrangements for such transactions. Mark is also the Task Team Leader for the Recommended PPP Contractual Provisions Initiative.

Victoria Rigby Delmon is a senior infrastructure lawyer with the Water Global Practice of the World Bank, based in Tanzania, and advises on legal and regulatory reform of the water and transport sectors and on PPPs. She brings over 20 years of legal experience working on infrastructure projects and regulation, including water, solid waste, and transport projects. She is the senior task team leader for the World Bank’s PPP Legal Resource Center (formerly known as PPP in Infrastructure Resource Center). Prior to joining the World Bank she worked for the international law firm Freshfields Bruckhaus Deringer and as international counsel for the utility company Veolia Environment. She is co-editor of “International Project Finance and PPPs” (third edition 2013), published by Kluwer/ Aspen Publishing.

Discussants:

Caroline Nicholas works with the main international players in procurement and procurement reform (such as WTO, the World Bank and MDBs) to promote harmonization in procurement rules and to support international trade and development.

Peter Fitzgerald has been representing multilateral agencies, commercial bank lenders and project developers on international project financings for over 30 years. He has particular experience of energy and other infrastructure projects in the emerging markets of Latin America, Asia, Africa, and the Middle East and specializes in the negotiation of project financings involving multilateral and/or bilateral agency support.
