This Application Note is designed to help Authorities and their advisers develop, evaluate and implement cost-effective strategies for managing interest-rate and inflation risks under PFI Contracts.

It reflects experience gained across the public sector in implementing PFI projects and should be viewed as a statement of best practice.  Authorities should always seek suitable professional advice in relation to interest rate and inflation risk issues.

To strengthen the current regime for PPPs, and increase the confidence of both public and private sector participants in this market, HM Treasury and Infrastructure UK, in coordination with government colleagues, have been focusing on the following areas:

Standardisation of PFI Contracts: Version 4

In July 1999 the first edition of Standardisation of PFI Contracts was published. The aim was to provide guidance on the key issues that arise in PFI projects in order to promote the achievement of commercially balanced Contracts and enable public sector procurers to meet their requirements and deliver best value for money. Second and third editions have followed in September 2002, and April 2004, together with an Addendum in December 2005.

A New Approach to Public-Private Partnerships

This document sets out the Government’s new approach to involving private finance in the delivery of public infrastructure and services through a long-term contractual arrangement, Private Finance 2 (PF2). This continues to draw on private finance and expertise in the delivery of public infrastructure and services whilst addressing past concerns with PFI and responding to the recent changes in the economic context.

PF2: User Guide

HM Treasury have issued a new policy document and new contract standardisation guidance for PF2 as follows:

(a) “A New Approach to Public Private Partnerships” (“PF2 Policy”) (http://www.hmtreasury.gov.uk/infrastructure_ppp_contractual.htm) and

(b) “Standardisation of PF2 Contracts” (“PF2 Guidance”) ((http://www.hmtreasury.gov.uk/infrastructure_ppp_contractual.htm).

PF2 Guidance replaces the old PFI guidance named “Standardisation of PFI Contracts Version 4” which was issued in March 2007 (“SoPC 4”).
